Legal Matters: Parents entitled to four months parental leave.

The Aubrey Masango Show - Un pódcast de 702

On Legal Matters, we talk to Osborne Molatudi, Founder of Molatudi Attorneys and Employment & Labour Law Expert, about a recent ruling by the Johannesburg High Court that ssections of the Basic Conditions of Employment Act (BCEA) and the Unemployment Insurance Fund (UIF) Act have been declared unconstitutional because, when it comes to “maternity leave”, they unfairly discriminate against mothers and fathers, surrogate parents, and those who adopt children. Judge Roland Sutherland suspended the declaration of invalidity for two years to give parliament time to “cure the defects”. This means that the ruling has to be confirmed by the Constitutional Court, and the minister of labour may note an intention to apply for leave to appeal it. What does all of tis mean, Osborne Molatudi, our labour law expert joins us to give a better understanding of this high court judgement.See omnystudio.com/listener for privacy information.
